CLUB MEMBERSHIP AGREEMENT
This Membership Agreement (“Agreement”) is entered into between The Little Movie Store (“the Store,” “we,” “us”) and the individual enrolling in the Club membership program (“Member,” “you”), effective as of the date of enrollment.
1. Membership Fee and Term
Club membership is $160 per year, payable in full at enrollment. Membership is valid for twelve (12) months from the enrollment date* and grants access to the benefits described in this Agreement for that period.
*For Pre-Sale Memberships, membership starts the date of business open.
2. Rental Library Access
As a Member, you may check out up to three (3) movies at a time from the Store's rental library. There is no limit on the number of separate checkouts over the course of your membership term, provided you are in good standing and are not currently holding overdue items.
3. Rental Period
Each movie is due back within fourteen (14) calendar days of checkout. You are responsible for returning movies to the Store by the due date, in the same condition as when checked out, normal wear excepted.
4. Overdue Items and Replacement Charge
If a movie is not returned within 30 days of its due date, it will be treated as lost, and you will be charged the current market rate to replace it. The Store will determine market rate based on the item's current retail or comparable resale price at the time of the charge. Once the replacement charge is paid, the item is considered your property and no longer needs to be returned.
5. Lost or Damaged Items
If a rented movie is lost, stolen, or damaged beyond normal wear while in your possession — at any point during the rental period, not only after three weeks — you agree to pay the Store's market-rate replacement cost for that item.
6. Renewal
Membership renews automatically each year at the then-current annual fee unless you cancel before your renewal date. The Store will make reasonable efforts to notify you before renewal charges are applied.
7. Cancellation
You may cancel your membership at any time by notifying the Store. Cancellation stops future renewals but does not entitle you to a refund of any portion of the current year's fee already paid. Any movies checked out at the time of cancellation remain subject to the rental period, overdue, and replacement terms in this Agreement until returned or paid for.
8. Suspension and Termination
The Store may suspend or terminate a membership, including rental privileges, if a Member has unresolved overdue items, unpaid replacement charges, or otherwise misuses the rental library. Termination for cause does not entitle the Member to a refund.
9. Member Responsibilities
You agree to provide accurate contact information, keep it up to date, and use rented items for personal, non-commercial use only. You may not sublease, resell, or transfer rented movies to any other person.
10. Limitation of Liability
The Store is not liable for indirect, incidental, or consequential damages arising from your membership or use of the rental library. The Store's total liability under this Agreement will not exceed the annual membership fee paid by the Member.
11. Changes to This Agreement
The Store may update the terms of this Agreement from time to time. Members will be notified of material changes before they take effect. Continued membership after changes take effect constitutes acceptance of the updated terms.
12. Governing Law
This Agreement is governed by the laws of the State of Pennsylvania, without regard to conflict-of-law principles.
